1. General


EasyMotionSkin Tec GmbH, FN 538049z, Gewerbegebiet 47, A-6103 Reith bei Seefeld ("Operator") operates on its website under the domain easymotionskin.com, among other things, a webshop ("Webshop"), by means of which the user ("User") is enabled to browse and order the goods and products offered there by the Operator ("Website Use"). The use of the Website and the Webshop is enabled on the basis of the following provisions.


2. Inclusion of the general terms and conditions


The Operator's General Terms and Conditions of Business ("GTC"), as amended from time to time, shall apply to all transactions concluded via the web store.


3. Conditions of use


Website use is possible for both registered and non-registered users.

The provision of the necessary technical requirements for access to the web store is the responsibility of the User, who also bears all access and data transfer costs. The user shall also ensure that his IT system has the security precautions expected according to the current state of the art and that all security updates for the installed operating system and the browser used are available.


4. Registration and deletion of the webshop account


Users are enabled to create a personal user account in order to use the webshop as a registered user ("Registration"). As part of the registration process, the first name, last name, address, date of birth and e-mail address must be provided. 
In the next step, the password must be set and the user must confirm that he/she has read and understood the General Terms and Conditions and these Terms of Use. By subsequently pressing the "Register" button, the registration application is transmitted electronically to the Operator. As soon as the registration application has been received, an e-mail message with an activation link will be sent to the e-mail address provided by the User during registration. By clicking on the activation link, the registration process is completed and the personal user account is activated. From this point on, the user can use the webshop as a registered user at any time. The login to the user account takes place via the button "Login" with subsequent entry of the access data specified in the registration procedure. Once the User is logged in to his/her web store user account, he/she can place orders as a registered user.

First of all, the e-mail address and the password are to be kept safe and confidential by the User on his own responsibility. The password must be of sufficient length and combination of numbers, special characters and upper and lower case letters against brute-force attacks.

For security reasons, it is recommended to log out after each use and purchase.

Users are obliged to provide all data required for the purpose of their registration or processing of purchase orders completely and correctly and shall bear full liability for any incorrect or inaccurate information provided.

The operator reserves the right to block or temporarily deactivate user accounts that violate these terms of use without prior notice, without the user being able to derive any claims of any kind against the operator or third parties from this.

6. Costs


The mere use of the website is free of charge. The operator reserves the right to monetize the offer on the website also by placing online advertisements.

7. Industrial property rights


The operator is exclusively entitled to industrial property rights. These contents are protected by copyright, trademark law and/or other laws. The Operator's intellectual property may not be used or otherwise impaired without the Operator's express written consent. Intellectual property may not be copied, reproduced, modified, downloaded, transmitted or otherwise exploited without the prior written consent of the Operator. By using the services, the user does not acquire any industrial property rights.
 

8. Data protection


The personal data of users collected in the course of website use shall be processed in accordance with the relevant data protection provisions as amended from time to time. Details of data processing can be found in the Operator's data protection declaration in the currently valid version.

9. Availability and Accessibility of the Webshop & Disclaimer


The Operator provides services on an "as is" and "if available" basis, and points out that all warranties of any kind are excluded. The Operator does not warrant that the Services will meet the needs of Users, will be secure, or will be uninterrupted, timely, accurate, or error-free.

The User is aware that the services accessible via the Internet are subject to typical failure risks that cannot be controlled by the Operator. In this respect, the Operator does not guarantee the uninterrupted functionality and accessibility of the webshop and the website. In particular, necessary maintenance work, compelling security reasons as well as events outside the control of the Operator (e.g. disruptions of public communication networks and the Internet, power failures or similar events) can lead to disruptions or to the temporary cessation of the accessibility of the web store and the website.

11. Jurisdiction and applicable law


Jurisdiction and applicable law are governed by the GTC.
